To address the shortage of family assistants, decree n°2026-1011 now allows public servants to combine, under certain conditions, their public employment with the lucrative accessory activity of a family assistant. This measure aims to expand the pool of professionals available for child welfare.
The exercise of this accessory activity is subject to several conditions. It requires prior authorization from the hierarchical authority. Furthermore, the placement is limited to a single individual, whether a minor or a young adult under 21 years old, who is of school age, a student, or employed. The placement must also be continuous or intermittent, in accordance with the provisions of the Code of Social Action and Families (CASF).
Additionally, the decree amends Article D.422-7 of the CASF, stipulating that childminders and family assistants employed by a public legal entity may engage in another activity, in compliance with the combining rules set forth by the General Code of Public Service (CGFP).
These provisions, detailed in Articles R.123-7 et seq. of the CGFP and Article D.422-7 of the CASF, come into effect on October 31, 2026.
